Internet Polka Music Broadcasting Only 

 

This licensing program provides 'Internet Polka Broadcasters' the right to broadcast polka music listed within our repertoire, without charges normally imposed by law through Sound Exchange.  Currently, the authorization to broadcast music via our repertoire is only extended to Internet polka broadcasters that  broadcast via their website (not terrestrial radio) OR Non-Commercial Educational Stations that simulcast polka music on the Internet OR Terrestrial radio stations that are 'primary polka broadcasters' (station programming of more than 50 percent which is polka music) who also simulcast on the Internet OR any future form of media that is developed for the purposes of representing present-day Internet Broadcasting under the previous criteria.  At this time, we are not representing any satellite radio stations or commercial radio stations that are normally not considered primary polka broadcasters.

Publishers/Bands/Agents/Representatives Only Need To Register One Time For Their Recordings (All Encompassing) But Please Ensure  All Information Is Accurate Before Accepting Terms When Submitting Information.  You Will Not Be Able To Correct Errors Once You Submit Your Information.

Terms and Conditions

The licensing maintained by Polka America Corporation only represents Polka Internet Broadcasters as described above.  Polka bands and publishers or agent/representative must register on this site in order for their polka music to be broadcast on the Internet free of licensing fees normally charged by Sound Exchange.  If you are a polka band or publisher and do not register on this website, Internet Broadcasters as described in the above will not be able to air  your music on the Internet unless those broadcasters provide payment to Sound Exchange.  Please be informed that this licensing program was created to ensure polka music survives on the Internet.  Terrestrial Radio does not have to pay Sound Exchange royalties.  Only Internet Broadcasters have been singled out to pay fees to Sound Exchange.  By licensing through Polka America Corporation, you will afford an equal opportunity for Internet Broadcasters (as described above)  to air polka music in an environment that is more representative of fees terrestrial radio pays to the music industry for broadcasting.  NOTE:  Stations/websites broadcasting do not register on this site.

IF YOU ARE BROADCASTING ONLY BY OUR REPERTOIRE, YOU WILL NOT HAVE TO REGISTER FOR A STATUTORY LICENSE WITH SOUND EXCHANGE. ~~ Sound Exchange has requested a listing of who is using this repertoire.     Disclaimer:  Polka America Corporation is not a registered agent  nor is an affiliate with Sound Exchange. 

Licensing on this site does not prevent broadcasters from paying composer royalties enforced by ASCAP, BMI, and SEASAC. Broadcasters must carry licenses with ASCAP, BMI, and SEASAC or a company that provides payment to these three agencies by the broadcaster.  The responsibility for composer royalties rests upon the broadcaster.

Bands and publishers, their representatives or agents, may still register with Sound Exchange for purposes of receiving payment for polka music that is broadcast by satellite radio or commercial radio stations that simulcast on the Internet not covered under the licensing provisions of Polka America Corporation.  For more information on registering with Sound Exchange, go to their website at  www.soundexchange.com
